Trademark Registration FAQs

A trade mark is a sign that identifies the goods and services of different traders. A trade mark may consist of words (including a person's name), symbols, designs, letters, characters, numerals, graphic elements, colours, sounds, smells, the shape of the goods or their packaging, and any combination of these marks. A mark may be registered as a trade mark only if it is capable of being expressed in writing or drawing.

Once your trade mark is registered, you have the exclusive right to use it in connection with the goods and services in question. If another business uses your registered trade mark for the same or similar goods or services without your consent, this is an infringement and you may take legal action. If the trade mark is not registered, it is more difficult to prove that you are the "owner" of the trade mark and your protection is limited.

Qualifications of Applicants Hong Kong law does not have any special requirements on the qualifications of trademark applicants. Natural persons or corporate bodies can apply for trademark registration, and the law does not require that the trademark applicant must have used the trademark applied for, and the applicant only needs to point out the use or intended use of the trademark when applying for trademark registration. The applicant must complete the relevant application form and submit it to the Trade Marks Registry together with a sample of the trade mark and the relevant fee. Hong Kong also adopts a one-trademark-one-category system of application for authorisation of trade mark registration, and the classification also adopts the 45 categories of the international classification. Trademarks may be registered as designs, names, signatures, characters, fonts, numerals, signs of different shapes or colours, or combinations of the above, as well as subject-matter graphics and geographical names. Service marks are also protected in Hong Kong, and trademarks for retail services can be applied for in Hong Kong. A special requirement for applying for trade mark registration in Hong Kong is that the Trade Marks Registry has the power to require the applicant to complete all application procedures within 12 months from the date of application. If the applicant fails to comply with this requirement, the application may be regarded as abandoned.

 

Upon registration of a trade mark, it is valid for 10 years from the commencement date, at which time it will need to be renewed.
